Recent empirical studies reveal a marked growth of right-to-health litigation in some Latin American countries.1 In Colombia, the region’s most litigious country, between 1999 and 2011 975.551 lawsuits invoked the right to health to demand a health care service—in most cases a pharmaceutical. In 2008, with a total of 144,957 lawsuits the right to health became the most litigated basic right in Colombia. According to a set of studies published by the Ombudsman’s office, from 1999 to 2008 health care-related actions increased 300%.
